DMCA Policy

Jaime Jaquez Jr College respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond promptly to notices of alleged copyright infringement that are reported to our Designated Copyright Agent, identified below.

Filing a Notice of Copyright Infringement

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Jaime Jaquez Jr College website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of a valid DMCA Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged content from the website.

  1. Identification of the copyrighted work: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: Provide a description of the material that you claim is infringing and its location on the Jaime Jaquez Jr College website. Please be as specific as possible to allow us to locate the material (e.g., URL of the specific page or file).
  3. Contact Information: Your address, telephone number, and email address.

  6. Electronic or Physical Signature: Your electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

Counter-Notification Procedures

If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to our Designated Copyright Agent:

  • Identification of the removed material: Identify the specific URL or other unique identifying information of the material that Jaime Jaquez Jr College has removed or to which access has been disabled.
  • Contact Information: Your name, address, telephone number, and email address.
  • Statement of Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Jaime Jaquez Jr College may be found), and that you will accept service of process from the person who provided the original notification of alleged infringement.
  • Statement of Good Faith Belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Electronic or Physical Signature: Your electronic or physical signature.
